I, the undersigned, acknowledge that this Performance Release (“Agreement”) is for my volunteer services for King Jesus International Ministry (the “Church”). I agree to perform creative services that may include, without limitation, as a musician and/or vocalist as part of the Church’s worship team and, at the Church’s election, I will perform during Church services, Church events and other Church activities (the “Services”). I hereby acknowledge and agree that the Church may record, in audio-only or audio-visual format, my Services and use such recordings in any medium now known or hereinafter developed, as determined by the Church.
I agree that any past and future performance of my Services is subject to this Agreement. I acknowledge and agree that I am performing the Services on a volunteer basis and am not owed monetary compensation for performing such Services and for any past, present, or future use of my Services by the Church, its affiliates, assignees, distributors and/or its licensees.
The Church shall own the entire worldwide right, title and interest, including the exclusive and perpetual copyright in my Services from inception and may edit, alter, prepare derivative works, exploit and publicly perform my Services in any manner that the Church may choose, through any markets, by any means, and in any format, now or later known, free from any claims by me, or any person, firm, or corporation claiming through me. It is hereby specifically agreed and understood that for all purposes of the United States Copyright Act (as amended), the results and proceeds of my Services shall be deemed to have been performed for the Church on a “work made for hire” basis. Alternatively, I hereby grant to the Church the entire worldwide right, title and interest derived from me including, without limitation, the copyright in and to my Services, and my execution of this Agreement shall be deemed an assignment thereof to the Church.
The Church shall have the perpetual, non-exclusive, and universal right to use and to permit others to use, without any additional consideration to me, my legal and professional name, whether presently or later used by me, my likeness, photograph, and other identification and biographical material concerning me, in connection with my Services and the Church.
I acknowledge and agree that: (i) I am not a member of an artist or musician’s union; (ii) I am at least 18-years of age; and (iii) the results and proceeds of my services will not violate or infringe upon the rights of any other party or applicable law. Delivery of this Agreement by electronic means shall be effective as delivery of an original signature of this agreement. This Agreement constitutes the sole and entire agreement for my Services with all other discussions or writings being merged herein.
